Guaranteed salary

Are you labourer or an office worker? In that case your salary will be paid by your current employer at the start of your incapacity for work. This is called guaranteed salary. During the period of guaranteed salary you don't yet receive a benefit payment from the health insurance fund.

What is the guaranteed salary?

Are you no longer able to work due to illness or an accident? Then you are incapacitated for work. At the start of your incapacity, your employer will normally continue to pay your salary. This is so if you are still employed, and if you have been employed for a sufficient period of time. The period of ‘guaranteed salary’ depends on your employment status.

Office workers receive guaranteed salary from the employer for the first month (30 calendar days). This is the wage to which you are entitled as an office worker if you cannot work due to illness or accident. The guaranteed salary of a labourer consists of about two weeks' pay. The guaranteed salary is a percentage of your gross salary. For any questions about this, please contact your employer.

When will you receive the guaranteed salary?

Your employer will pay you your guaranteed salary in the first month of your incapacity for work. Office workers will receive 30 calendar days of guaranteed salary. Labourers  will receive two weeks worth of salary. Will you be incapacitated for longer? Then submit a declaration to your health insurance fund as soon as possible. You can apply to claim benefits by making a declaration of incapacity for work. Keep in mind that a notification period is applicable. The period of guaranteed salary is expressed in calendar days

Are you not receiving guaranteed salary because, for example, you are a job seeker and have become incapacitated for work? In that case, for the period from your first day of incapacity for work, you will receive benefit payments from the health insurance fund. 

What if you are not able to work for a longer period?

Have you been incapacitated for longer than the period of guaranteed salary? Then submit a declaration of incapacity for work to your health insurance fund. That way, you can  apply for benefits. Keep in mind that there is a notification period. After the guaranteed salary period expires, you may receive benefits because of 'primary incapacity for work'.

What do you need to do if you have a relapse?

Imagine: you are no longer incapacitated and you go back to work. You become incapacitated again within two weeks after a period of incapacity of less than a year, or within three months if you were previously incapacitated for over one year. This is referred to as a relapse.

So you are incapacitated again, regardless of the medical diagnosis that caused it. If you receive the same medical diagnosis as previously, you will receive the remaining part of your guaranteed salary from your previous period of incapacity from your employer. If you receive a different medical diagnosis, you will receive another full period of guaranteed salary from your employer. Once this period is fully expired, you will receive benefit payments from your health insurance fund.
